By means of this petition filed under Article 226 of the Constitution, petitioner, who has taken voluntary retirement from respondent establishment and approval to which has been granted, is aggrieved by the show cause notice dated 25.09.2024 and subsequent order issued on 21.02.2025. It is submitted that it was the respondents' duty to get the service book of the petitioner duly verified and in the circumstances, he cannot be saddled with any liability to pay back any amount towards the audit objection, if undertaken. It is further submitted that the petitioner since has already retired, he ceased to be an employee of respondent establishment and the duty of the respondent establishment was first to clear the retirement dues or at least some provisional pension or payment of the kind which may have enabled the petitioner to sustain.
