It is submitted that the Tribunal in the order impugned directed for payment of arrears for a period of three years before the date of filing the Original Application, however, the issue of payment of arrears pursuant to judgment of Hon'ble Supreme Court in Director (Admn. and HR) KPTCL & Ors. Vs. C.P. Mundinamani & Ors : (2023) SCC Online SC 401, is now decided by Hon'ble Supreme Court in Misc. Application Diary No. 2400 of 2024 in Civil Appeal No. 3933 of 2023 (Union of India & Anr. Vs. M. Siddaraj) vide judgment dated 20.02.2025, wherein Hon'ble Supreme Court has inter alia directed that the judgment will be given effect to from the date of judgment i.e the pension by taking into account one increment will be payable on and after 01.05.2023 and enhanced pension for the period prior to 30.04.2023 will not be paid
