Counsel appearing for the Municipal Corporation has produced instructions inter alia indicating that there has been litigation between the Municipal Corporation and respondent nos. 7 to 10 of which respondent nos. 7 to 9 have died, wherein the suit filed by the said respondents has been decreed, first appeal filed by the Municipal Corporation has been dismissed and the second appeal has also been dismissed for non prosecution regarding which a restoration application is pending consideration and in execution of the said decree, possession of the land in question has been taken by the respondent no. 10 - plaintiff decree holder. 2. In view of the above fact situation, which facts the petitioner has neither investigated nor has indicated in the petition, no case for passing any order in a petition filed in public
