Learned counsel for the State has obtained instructions from the concerned Tehsildar, and a copy of the same has been placed before us, which is taken on record. As per the said instructions received by the State, proceedings under Section 67 of the U.P. Revenue Code, 2006, have already been initiated against the illegal encroachment upon Gata No. 1078, recorded as Kumhar Miti, to the extent of 0.2180 hectares. Once proceedings for removal of illegal encroachment have been initiated against the illegal occupants, we see no reason to keep the present petition pending for the reliefs sought herein.
