That it is relevant to mention here that Respondents have evicted the person, who have encroached the public utility land in encroachment has been removed, therefore, the grievances of the petitioner for filing the present writ petition has been resolved." In view of the fact that the parties have acknowledged that the public utility land comprising a Chak Marge in Araji No. 134/0.214 hectares and Plot No. 132/0.81 hectares situate in Karmaha, Tehsil Tamkuhiraj, District Kushinagar has all been rid of encroachment now, no cause of action survives. In this view of the matter, no further orders are required to be made in this P.I.L. It is consigned to record.
