The present writ petition has been filed with the prayer to quash the impugned First Information Report dated 06.05.2025 registered as Case Crime No.138 of 2025 under Sections 115 (2), 333, 351 (2), 109 B.N.S., Police Station Basauli, District Budaun. Further prayer has been made not to arrest the petitioners in the aforesaid case. 3. Learned A.G.A., on the instructions, states that during the investigation, Section 109 of BNS has been deleted and the charge sheet is already submitted before the competent court on 19.05.2025. As such, the cause of filing the writ petition no more survives and the writ petition is liable to be dismissed as infructuous. 4.
