Hon'ble Krishan Pahal,J. 1. List has been revised. 2. Heard Sri Shiv Sagar Singh, learned counsel for the applicant and Sri R.P. Patel, learned State Law Officer and also perused the material placed on record. 3. Applicant seeks bail in S.C. No. 728 of 2022 arising out of Case Crime No. 158 of 2021, under Sections 376(2)(L), 376(2) (N), 452, 506 of IPC, Police Station - Uruwa Bazar, District - Gorakhpur, during the pendency of trial. 4. As per prosecution story, the applicant is stated to have committed rape with the sister of the informant on 13.11.2021 at about 12:00 PM. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence as alleged in the FIR. The FIR is delayed by about 14 days and there is no explanation of the said delay caused. 6. Learned counsel has also stated that
