The instant bail application has been filed on behalf of the applicant with the prayer to release him on bail in Case Crime No.388 of 2024, under Section 103(1) BNS, Police Station Barkhera, District Pilibhit during pendency of the trial. 4. Learned counsel for the applicant submits that it is a case of circumstantial evidence and applicant was not named in the FIR and FIR of the present case was lodged against co-accused Gasid but during investigation on the basis of statement of witnesses Mustafa Ali and Yusuf, he has been made accused in the present matter. 5.
