It is submitted by learned counsel for the applicant that FIR in this case was lodged against unknown persons at the instance of SSI of P.S. Kotwali Dehat, District Etah with averment that some unknown smugglers of beef had taken for sale and carcass of the same is lying; huge crowd of villagers is gathered there and there is so much outrage in public; case was registered under the Cow Slaughter Act. During investigation, three persons Akash, Juber and Shakir were arrested by the police on 10.5.2023 on charge of opening fire on police team and separate case bearing Case Crime no. 104 of 2023, under sections 307, 411, 427 IPC and 3/4/25/27 of Arms Act was registered against them.
