The instant application has been filed seeking release of the applicant on bail in Case Crime No.816 of 2024, under Sections 115(2), 352, 351(3), 126(2), 103(1), 109, 61(2), 3(5) B.N.S., 2023, Police Station Gola, District Gorakhpur, during pendency of the trial in the court below. 3. Learned counsel for the applicant submits that however, applicant is named in the FIR but admittedly he was not present at spot and with aid of Section 61(2) B.N.S., he has been made accused in the present matter for hatching conspiracy. 4.
