This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Sakib, seeking enlargement on bail in Case Crime No. 656 of 2024, under Sections 115 (2) and 351 (2) the Bharatiya Nyaya Sanhita, 2023 and Section 3A/4 (2) of POCSO Act, Police Station Deoband, District Saharanpur. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 29.11.2024. Learned counsel for the applicant submits that there is an inordinate delay in lodging the FIR. As per pathology report, no spermatozoa was seen dead of alive. Charge-sheet in this case has already been filed on 3.1.2025. N
