The instant bail application has been filed on behalf of the applicant, Islam, with a prayer to release him on bail in Case Crime No. 373 of 1991, under Sections 147, 148, 149, 307, 366, 376, 452 IPC, Police Station Khair, District- Aligarh, during pendency of trial. There are allegations against the applicant and other co-accused in the FIR regarding commission of offences of rape, rioting and attempt to murder, kidnapping, etc. Learned counsel for the applicant has submitted that from the FIR and the statement of the victim recorded under Section 164 Cr.P.C., main accused is stated to be co-accused, Rafeeq. The applicant has been falsely implicated in this case. He has not been assigned any specific role in the commission of alleged offences. He has criminal history of five cases to his credit and is languishing
