There are allegations against the applicant of abduction of minor girl with intent to marry, commission offence of rape and also cheating etc. Learned counsel for the applicant submits that from the statement recorded under Section 164 Cr.P.C she is clearly a consenting party. She is not minor. As per radio-logical report her age has been found 17 -18 years. Implication under POCSO Act is unjustified. Learned AGA has opposed the prayer for bail but could not dispute the above submissions.
