Learned A.G.A informs that notice has been served on informant but no one has turned up to oppose this bail application. There are allegations against the applicant of abduction of minor girl with intent to marriage, commission of offences of rape, criminal intimidation and offence under POCSO Act. Counsel for the applicant informs that the victim is although minor but she has admitted eloping with the applicant and going to Bihar. She was clearly a consenting party and has implicated the applicant only after she was recovered by police. The applicant is in jail since 13.04.2024 and has no criminal history to his credit. On the other hand learned A.G.A has opposed the prayer for bail. This court had to consider whether the implication under POCSO Act would be justified where the victim appears of have consented to her relat
