Heard learned counsel for the applicant and learned A.G.A for the State. There are allegations against the applicant of abduction of minor girl with intent to marry, commission of offence of rape and penetrative sexual assault. Counsel for the applicant has pointed out from the statement of victim recorded under Section 164 Cr.P.C., which shows that she is although aged about 16 years but has neither made any allegation of abduction nor rape against the applicant. Subsequently the investigating officer has exonerated the applicant of commission of offence under Section 3/4 of POCSO Act. The applicant is in jail since 13.08.2024 and has no criminal history to his credit. On the other hand learned A.G.A has opposed the prayer for bail. Keeping in view the nature of the offence, evidence, complicity of the accused, subm
