The instant bail application has been filed on behalf of the applicant, Brahmjeet Alias Birmu, with a prayer to release him on bail in Case Crime No.39 of 2024, under Sections 376-AB IPC and Section 5M/6 POCSO Act, Police Station Shikarpur, District- Bulandshahr, during pendency of trial. There are allegations against the applicant of committing the offence of rape against a minor girl, aged about four years. Learned counsel for the applicant has submitted that the victim in her statement has stated that applicant only disrobed her and touched her private part. No allegation of commission of offence of penetrative rape has been levelled. He has further submitted that there is dispute between the family members of the applicant and victim in the village. It is a case of false implicati
