The instant bail application has been filed on behalf of the applicant, Pattu Alias Ravidas, with a prayer to release him on bail in Case Crime No. 0037 of 2024, under Sections 376-AB IPC and Section 5m/6 POCSO Act, Police Station Adalhat, District- Mirzapur, during pendency of trial. There are allegations against the applicant of committing the offence of rape against a minor girl, aged about 5 years. Learned counsel for the applicant has submitted that the medical report of the victim does not supports the prosecution case. Family members of the victim and applicant are related as collaterals. There is dispute regarding property between the parties. The applicant has been falsely implicated in this case. He has no criminal history to his credit and is languishing in jail since 13.3.20
