Learned AGA informs that notice has been served on the informant, but no one has turned up to oppose the bail application. Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Babu, with a prayer to release him on bail in Case Crime No.428 of 2024, under Sections 376AB IPC and Section 5m/6 of POCSO Act, Police Station Majhola, District- Moradabad, during pendency of trial. There is allegation against the applicant of committing of offence of rape against the minor girl. Learned counsel for the applicant has submitted that it is a case of false implication. The victim is cousin of the applicant. The medical examination report of the victim does not support the prosecution case at all. There is dispute between elder family members
