Rejoinder affidavit filed today is taken on record. There are allegations against the applicant of committing the offence of rape against minor girl. Counsel for the applicant submits that the victim met the applicant along with her friend, Iram. She stayed back with the applicant and asked Iram to go. Iram has admitted that she was asked by the victim to go and she stayed with the applicant. Thereafter, the victim alleges that she was subjected to the offence of rape by the applicant. Counsel for the applicant also submits that the victim may be minor but she had consenting relationship with the applicant who is in jail since 21.04.2024 without having any previous criminal history. On the other hand learned A.G.A has opposed the prayer for bail. This court had to consider whether the implication under POCSO Act would be justified where the victim
