There are allegations against the applicant of committing offence of rape and criminal intimidation against the victim. Learned counsel for the applicant submits that victim in her statement under section 164 Cr.P.C. has stated that she was sleeping in her house with her parents brother and sister. .Applicant entered into her house and putting hankerchief on her face picked her and committed offence of rape.The statement of the victim recorded under section 161 Cr.P.C. itself is doubtful, when applicant entered into her house , why the victim has not raised alarm for help.How the applicant entered her house when all the family members were sleeping has not been explained.Whether there were no doors in the house of which has also not been stated.
