Heard Shri Sudhir Kumar Agarwal, learned counsel for the applicant and Shri Ajai Singh, learned AGA-Ist, for the State- respondents and perused the record. This bail application under Section 439 Cr.P.C. has been moved on behalf of accused-applicant, Smt. Sanyogita, seeking enlargement on bail in Case Crime No. 160 of 2024, under Sections 323, 328, 109, 366A, 506 I.p.C. and Section 16/17 POCSO Act, Police Station Titwai, District, Muzaffar Nagar. Learned counsel for the applicant has stated that the applicant is absolutely innocent and has been falsely implicated in the present case. Learned counsel has further stated that the prosecution witnesses i.e. P.W.1 is the informant, P.W.2 is the eye witness and P.W.3 is the victim, have not supported the prosecution story and they have turned hostile.
