Heard Ms. Juhi Srivastava, learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Amit Kumar, with a prayer to release him on bail in Case Crime No. 84/2024, under Sections 376, 376(3) of IPC, and section 4(2)/6 of POCSO Act, and section 9/11 of the Prohibition of Child Marriage Act, Police Station- Jamalpur, District- Mirzapur, during pendency of trial. There are allegations against the applicant of committing the offence of rape of a minor girl and her abduction with intent to marry. Learned counsel for the applicant has submitted that from the statement of the victim recorded under section 164 Cr.P.C., she is minor, but she has admitted marrying the applicant and giving birth to a child.
