Heard learned counsel for the applicant; learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Sandeep, with a prayer to release him on bail in Case Crime No. 243 of 2022, under Section 376 IPC and 3/4 POCSO Act, Police Station Bilsi, District- Budaun, during pendency of trial. This is second bail application of the applicant. The first bail application of the applicant was rejected by this Court on 31.5.2023, which is not available. Learned counsel for the applicant has submitted that applicant has no criminal history to his credit and is languishing in jail since 24.6.2022. Before the trial court, victim and informant have already been examined. There is no possibility of tampering with the prosecution evidence. Per contra learned A.G.A. has opposed the prayer for bail of
