Hon'ble Siddharth,J. Learned A.G.A. informs that notice has been served upon the informant but no one appears on his behalf. Heard learned counsel for the applicant and learned A.G.A for the State. There are allegations against the applicant of committing offence of rape against the minor girl.. Learned counsel for the applicant submits that in the statement of the victim recorded under section 164 Cr.P.C.it is alleged that applicant gave her cold drink and after consuming it she fell unconscious thereafter victim did not knew what happened.Medical report of victim does not supports the prosecution case. The F.I.R. is delayed by more than two months. The applicant is in jail since 29.5.2024 and has no criminal history to his credit. On the other hand learned A.G.A has opposed the prayer for bail.
