Learned counsel for the applicant submits that the victim is aged about 21 years as per report of CMO. From her statement under Section 164 Cr.P.C she appears to be well known to the applicant and has admittedly eloped with the applicant earlier also. She has admitted physical relation-ship with consent with the applicant. He further submits that only after the applicant got married to another girl, the first information report has been lodged. Applicant is in jail since 20.07.2024 and has no criminal history to his credit. Learned AGA has opposed the prayer for bail but could not dispute the above submissions.
