Heard learned counsel for the applicant; learned AGA for the State and perused the material placed on record. The instant bail application has been filed on behalf of the applicant, Aayan, with a prayer to release him on bail in Case Crime No. 355 of 2024, under Sections 376 DB, 506 IPC and 5(G)M/6 POCSO Act, Police Station Gorakhnath, District- Gorakhpur, during pendency of trial. There are allegations against the applicant of committing the offence of rape of a minor girl. Learned counsel for the applicant has submitted that before the trial court, informant, who is mother of the victim, has been examined. She has been declared hostile. The applicant has been falsely implicated in this case. He has no criminal history to his credit and is languishing in jail since 29.6.2024. In case, the applicant is released on bail, he will not misuse the liberty of
