Counsel for the applicant submits that the victim is mentally retarded and her statement recorded under Section 164 Cr.P.C had been recorded with the help of interpretor but the victim was not confronted with the applicant so that she could have pointed out that the he has committed the alleged offence against her. From the medical report of the victim no sign of commission of offence of rape was found on her person when the same had taken place in the short time of commission of alleged offence.
