The instant bail application has been filed on behalf of the applicant, Vishal Kushwaha, with a prayer to release him on bail in Case Crime No. 113 of 2024, under Sections 363, 366, 376 IPC and 3/4 POCSO Act, Police Station Khadda, District- Kushinagar, during pendency of trial. There are allegations against the applicant of abduction of a minor girl with intent to marry, commission of offences of rape and penetrative sexual assault. Learned counsel for the applicant has submitted that it is a case of consent and not commission of offence of rape as clear from the statements of the victim
