The instant bail application has been filed on behalf of the applicant, Sahabuddin, with a prayer to release him on bail in Case Crime No. 148 of 2022, under Sections 376, 363, 225 IPC and 5m/6 POCSO Act, Police Station Tamkuhiraj, District- Kushinagar, during pendency of trial. This is third bail application of the applicant. Earlier bail applications of the applicant were rejected by co-ordinate bench of this Court, which has released this bail application. Learned counsel for the applicant has submitted that applicant has no criminal history to his credit and is languishing in jail since 20.10.2022.
