The instant bail application has been filed on behalf of the applicant, Naved, with a prayer to release him on bail in Case Crime No. 147 of 2023, under Sections 376-AB, 506 of IPC and section 5M/6 of POCSO Act, Police Station- Galshaheed, District- Moradabad, during pendency of trial. There is allegation against the applicant of committing the offence of rape against his minor sister-in-law. Learned counsel for the applicant has submitted that before the trial P.W.-1, P.W.-2 and P.W.-3 have been examined. P.W. -1 has supported the prosecution case while P.W.-2 , victim, and P.W.-3, (sister of the victim), have been declared hostile. The applicant has been falsely implicated in this case.
