The instant bail application has been filed on behalf of the applicant, Ankit @ Indu, with a prayer to release him on bail in Case Crime No. 628 of 2023, under Sections 376-AB, 506 IPC and 5M/6 POCSO Act, Police Station Modi Nagar, District- Ghaziabad, during pendency of trial. There are allegations against the applicant of committing the offence of rape and criminal intimidation against a minor girl. Learned counsel for the applicant has submitted that applicant has falsely been implicated in this case. Learned AGA has vehemently opposed the prayer for bail of the applicant and has submitted that the applicant has criminal history of three cases to his credit and two of them relate to the same offence.
