The instant bail application has been filed on behalf of the applicant, Ramdhyan Pal, with a prayer to release him on bail in Case Crime No. 101/2023, under Sections 376 of IPC and section 5M/6 of POCSO Act and section 3(2)(5) of SC/ST act, Police Station- Ekauna, District- Deoria, during pendency of trial. There is allegation against the applicant of committing the offence of rape against a minor girl belonging to scheduled caste. Learned counsel for the applicant has submitted that medical report of the victim does not supports the prosecution case. The applicant is aged about 60 years. He has been falsely implicated in this case. He has no criminal history to his credit and is languishing in jail since 27.10.2023.
