There are allegations against the applicant of committing the offence of rape against major and married woman after entering into her house. Counsel for the applicant submits that in the statement of the alleged witness, Raj Kumar, was recorded by the investigating officer in which he has supported the prosecution story but he is not eye-witness of the alleged incident. There is no explanation why he come on the spot after hearing the alarm of the victim and if the applicant committed rape against the victim then why said allegation has not been made in the F.I.R as well as in the statement of victim recorded under Section 161 Cr.P.C.
