The instant bail application has been filed on behalf of the applicant, Mohd Hasan, with a prayer to release him on bail in Case Crime No. 32/2018, under Sections 376(2) and 506 IPC, and section 5/6 of POCSO Act, Police Station- Pakbara, District- Moradabad, during pendency of trial. There is allegation against the applicant that he has committed the offence of rape against his step sister. Learned counsel for the applicant has submitted that applicant is the son of the earlier wife of the informant. The victim is the daughter of the second wife of the informant. Since second wife of the informant and informant wanted to get rid of the applicant, they have lodged the false F.I.R., against the applicant by implicating him through his step sister.
