The instant bail application has been filed on behalf of the applicant, Talib, with a prayer to release him on bail in Case Crime No. 225 of 2023, under Sections 363, 376D, 506 of IPC and 5g, 5L/6 of POCSO Act, Police Station- Hafizpur, District- Hapur, during pendency of trial. There is allegation against the applicant and co-accused, Dilshad, that they have abducted the victim and committed the offence of rape. Learned counsel for the applicant has submitted that from the statement of the victim it appears that the victim had consenting relationship with co-accused, Dilshad. The applicant being friend of the Dilshad has been falsely implicated in this case. As
