Heard Sri Devesh Pandey, learned counsel for the applicant, Sri Ram Mohit Yadav, learned A.G.A. for the State and perused the material placed on record. 3. Applicant seeks bail in Case Crime No.44 of 2025, under Section 64(1), 333 B.N.S., 2023, Police Station Balua, District Chandauli, during the pendency of trial. 4. As per prosecution story, the applicant is stated to have committed rape with the victim by entering into her shop and putting down the shutter on 13.02.2025 at about 6:30 p.m. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by about two days and there is no explanation of the said delay caused. The victim is 18 years old, as such is major and seems to be a consenting party.
