Heard Sri Janardan, learned counsel for the applicant and Sri Sunil Kumar, learned A.G.A. for the State and perused the record. 3. Applicant seeks bail in Case Crime No. 436 of 2024, under Sections 64, 74, 115(2), 351(2) of BNS Police Station Gauri Bazar, District Deoria, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence as alleged in the FIR. The FIR is delayed by about 10 days and there is no explanation of the said delay caused. 5. Learned counsel has also stated that the victim is major aged about 27 years. The allegations of outraging the modesty, as made in the FIR, has been escalated to that of rape by the victim in her statement recorded under section 183 BNSS and that too after legal consultation.
