The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Ishrat with a prayer to release him on bail in Case Crime No. 328 of 2024, under Section 3/5/8 of U.P. Prevention of Cow Slaughter Act, 1955, Police Station- Junawai, District- Sambhal. Learned counsel for the applicant submits that the applicant is not named in the FIR. Nothing incriminating has been recovered from possession of the applicant. Offence is triable by magistrate. The applicant is languishing in jail since 28.02.2025 and he has no criminal antecedent. He next submits that the Investigating Officer has already submitted the chargesheet in the matter and no useful purpose would be served by detaining the applicant.
