Heard Ms. Shaili Ganguly, learned counsel for the applicant, Sri Anil Kumar Singh, learned AGA for the State and perused the record. The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Raish Ahmaad with a prayer to release him on bail in Case Crime No. 541 of 2017, under Sections 3, 5, 8 of U.P. Prevention of Cow Slaughter Act, 1955, Police Station- Milak, District- Rampur. Learned counsel for the applicant submits that approx 80kg beef is alleged to have been recovered, but no scientific evidence or laboratory report is on the record to suggest that the recovered beef belong to cow progeny. There is no independent witness of the recovery. He next submits that the applicant is not arrested from spot and the co-accused who were arrested on spot, have already been granted bail. Offence is triable by magistrate. The applicant is languis
