The instant application has been filed seeking release of the applicant on bail in Case Crime No. 12 of 2022, under Sections 302, 34, 120-B IPC, Police Station- Kapurpur, District- Hapur, during pendency of the trial in the court below. 3. Learned counsel for the applicant submitted that FIR of the present case was lodged against co-accused Mukesh and Kailash with regard to murder of brother of the informant but during investigation, when after about three weeks, statement of sister of the deceased was recorded then on the basis of CCTV footage, she disclosed that on the date of incident, applicant was going on the motorcycle from near the house of the informant along with his brother. 4.
