Heard Sri Himanshu Mishra, learned counsel for the applicant and Sri Kuldeep Singh Chahar, learned counsel for the informant as well as Sri Rajendra Prasad Singh, learned State Law Officer and perused the record. 3. Applicant seeks bail in Case Crime No. 43 of 2025 , under Sections 64(1), 351(2), 331(4) of BNS and Sections 3/4 of POCSO Act and Section 3(2)(5) of SC/ST Act, Police Station Achnera, District Agra, during the pendency of trial. 4. As per prosecution story, the applicant is stated to have committed rape with the victim in the night of 25/26.02.2025 and committed aggravated sexual assault with her. There are allegations under the SC/ST Act also against the applicant. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence
