The instant bail application has been filed seeking release of the applicant on bail in Case Crime No. 15 of 2025, under Sections 115(2), 103(1), 3(5) B.N.S., Police Station Mirzapur, District Shahjahanpur during pendency of the trial. 3. Learned counsel for the applicant submits, however, applicant is named in the FIR along with two others but informant of the case was not an eye witness. 4. He further submits, during investigation statements of some eye witnesses were recorded, which have been annexed along with instant bail application and according to them co-accused Bacchu was the person, who caused wooden stick injury to the deceased and they made only allegation of exhortation against the applicant and there is no allegation that applicant also caused any injury to the deceased. 5.
