The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of applicant Pawan, with a prayer to release him on bail in Case Crime No. 803 of 2024, under Sections 96, 115 (2), 117 (2), 137 (2), 140 (4) of the Bharatiya Nyaya Sanhita, 2023 and Section 5/6 of POCSO Act, Police Station Chiluatal, District Gorakhpur. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 25.11.2024. Learned counsel for the applicant submits that there is no sign of penetration on the body of the applicant. The parents of the victim have refused for medical examination.
