The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant- Abhishek Chauhan with a prayer to release him on bail in Case Crime No. 196 of 2024, under Section 3/5A/5B/8 of U.P. Prevention of Cow Slaughter Act, 1955, Police Station- Chakia, District-Chandauli. Learned counsel for the applicant submits that 17 alive and 4 dead cattle are alleged to be recovered, but there is no independent witness of the recovery. The applicant was not arrested on spot and the on spot arrested co-accused have already been granted bail by the concerned court below. He next submits that the applicant is owner of the vehicle and has nothing to do with the alleged recovery. Offence is triable by magistrate. The applicant is
