This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Ravi Gaund, seeking enlargement on bail in Case Crime No. 26 of 2025, under Sections 351(3), 352 of the Bharatiya Nyaya Sanhita, 2023 and under Section 5/6 POCSO Act, Police Station Nebua Naurangia, District Kushinagar. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 16.01.2025. Learned counsel for the applicant submits that there are material contradictions in the statement of victim recorded under Sections 180 and 183 B.N.S.S. Further, it is submitted that no case under Section 351(3) B.N.S is made
