Learned counsel for the applicant submits, applicant was not named in the FIR but during investigation through the statement of co-accused he has been made accused in the present matter with the aid of Section 61(2) B.N.S 4. He further submits, as per allegation, applicant provided pistol to the principal accused who committed the murder of the deceased but except the statement of co-accused there is no other cogent evidence in this regard against the applicant on record. 5.
