Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material on record. By means of this application, the applicant, Manoj, who is involved in Case Crime No. 408 of 2019, under Sections- 394, 302, 201, 120B, 411, 34 IPC and Section 15 of the Dacoity Affected Area, P.S.- Khandauli, District- Agra and is in jail since 12.11.2019, is seeking enlargement on bail during the trial. It is submitted by learned counsel for the applicant that similarly placed co-accused, Yogendra @ China, has already been enlarged on bail by this Court by order dated 22.2.2024 passed in Criminal Misc. Bail Application No. 39972 of 2023. He has further submitted that since the role of the applicant is identical to that of co-accused, Yogendra @ China, who has already been enlarged on bail, he is also entitled to be enlarged on bail on the ground of parity and for the reasons given in the order of co-accused
