The present appeal has been filed against the judgment and order dated 09.09.2008 passed by Additional Sessions Judge, Fast Track Court No.3, Mainpuri, in Sessions Trial No.476 of 1998. 2. As per the Office report dated 19.05.2025, based on the report of learned Chief Judicial Magistrate, Budaun, dated 28.03.2025, the sole surviving appellant, namely, Sushil Kumar son of Mahesh Mishra died on 20.09.2023. We have perused the report of the Chief Judicial Magistrate along with the statements of Mahesh Mishra, father of sole appellant and the death certificate issued by Village Pradhan, Son Devi and the report of Senior Superintendent of Central Jail, Agra to the effect that the jail accused died on 20.09.2023 during treatment.
