The instant application has been filed under Section 389 of Cr.P.C. to suspend the sentence of conviction and to release the applicant on bail in Sessions Trial No. 24 of 2016 (State vs. Govind Rathor) arising out of Case Crime No. 969 of 2015, under Section 302 I.P.C., Police Station - Madhogarh, District - Jalaun. 4. Contention of the learned counsel for the applicant is that if the First Information Report is perused, it definitely shows that it did not match with the injuries as were on the body of deceased, and therefore, it gives credence to the statements of PW-1 where it was stated
