The instant petition has been filed praying for a writ of mandamus restraining the respondents from acquiring Khasra no.26 Khatauni no.76 situated at Village- Khan Alampura, Pargana and Tehsil- Sadar, District- Saharanpur without adopting legal proceedings. 2. The petitioner claims himself to be Mutwalli of Waqf No.260. He relies on a certificate issued in his favour by U.P. Sunni Central Board of Waqf on 04.11.1986. No recent certificate has been filed in support of the plea that the petitioner is Mutwalli of the Waqf. Moreover, some suit at the behest of the petitioner is admitted to be pending before the civil court in respect of Waqf property. 3. Having regard to the aforesaid facts, we are not inclined to examine the claim in exercise of writ jurisdiction. It is left open to the petitioner to avail such other remedy as may be advised. 4.
